Life imprisonment to man for killing wife

Confession made by the accused to his brother proves to be clinching evidence

Treating owning up to his brother as an extra-judicial confession, a Delhi court has sentenced a 30-year-old man to life imprisonment for the murder of his wife in north Delhi’s Samaypur Baldi last year.

After murdering his wife, accused Parveen Rana called his brother and told him that he had murdered his wife and the body was lying in his room. He also asked him to make a PCR call and inform the police about the murder.

The police had lodged an FIR in the matter based on a complaint by the accused’s brother and evidence by him proved a clinching factor in the conviction of Rana. The case was based on circumstantial evidence as there was no eyewitness to it.

“In my opinion, the circumstance of extra judicial confession is proved and established by the prosecution,” Additional Sessions Judge V.K. Bansal said.

Extra judicial confession

“The circumstances established i.e. the extra judicial confession made by the accused to Manjeet Rana [accused’s brother]; recovery of dead body on the second floor in the room of accused pursuance to this extra judicial confession by Rana and his mother; the strained relations of the victim and the accused; beatings to the victim by the accused on the night of 01.03.17 [a day before the murder], all these circumstances point towards the guilt of accused. I, therefore, hold the accused guilty and convict him for the offence punishable under Section 302 IPC,” Mr. Bansal said while convicting the accused.

Rejecting a plea for death sentence by the prosecution, the Judge said: “Keeping in view the submissions and the facts of the case that convict Parveen Rana had murdered his own wife by cutting neck with kitchen knife, he is sentenced to rigorous life imprisonment with fine of ₹50,000.”

Mr. Bansal also directed the Delhi Legal Services Authority, North District, to consider the matter for awarding compensation to the two children of the deceased.
