Jarnail Singh’s anticipatory bail extended till July 9

Stating that Aam Aadmi MLA Jarnail Singh had carried out all the conditions for anticipatory bail laid out by an earlier order, the High Court on Monday extended his bail till July 9, the next date of hearing in the case.

“Since the petitioner has joined investigation and is fully co-operating with the investigation agency and there are no chances of his absconding, in that event, he should be released on bail,” said the court of Justice Sunita Gupta.

The earlier conditions of bail had stated that he co-operate with the police in its investigations, not leave the city and not approach either to threaten or promise any persons involved in his case. He had also been ordered to hand over his mobile phone to the investigating officer.

The court also acknowledged the Delhi police’s allegations that the complainant in the case was not co-operating with the investigations because of the influence exercised by the MLA’s position. It directed the police to give the complainant police protection and re-iterated its previous order asking Singh to desist contacting the complainant for any reason.

“In view of the submissions made by learned ASG that due to the influence exercised by the petitioner, who is a sitting MLA, the complainant is not co-operating in the investigation, the State is directed to grant police protection to complainant, as and when required. It is reiterated that the petitioner shall not contact, coerce, threaten or influence the complainant in any manner,” said the court.

The MLA had been accused of assaulting an MCD engineer and the whole incident was said to be recorded on his phone, which the police said was deleted.

The court directed that his phone be sent to the forensic laboratory first, before hearing any other allegations by the police.

The court also acknowledged the Delhi police’s allegations that the complainant in the case was not co-operating with the investigations.
