High Court directs DDA to de-seal Games Village flats

The Delhi High Court on Thursday directed the Delhi Development Authority to de-seal eight flats in the Commonwealth Games Village within two days.

Justice Hima Kohli ordered de-sealing of the flats on a petition by CWG Allottees' Welfare Association, a body of owners of the flats, submitting that the Authority had sealed the flats in violation of the Court order that no coercive action would be taken against those allottees who were in possession of those flats which have been built in excess of the Floor Ratio Area (FAR) by the builder.

When the matter had earlier come to Court, it had directed the Union Urban Development Ministry to take a decision on the excess FAR built by the builder.

It had also asked the Authority not to use force to seal the flats till the Ministry takes a decision on that following a submission by it (Authority) that it would not take any action against the allottees.

The Court also pulled up the Authority for sealing the flats of the allottees after handing over their possession to them and taking no action when the builder was allegedly violating the limit of the FAR.

The flats were built by private builder EMAA-MGF to provide accommodations to sportsperson and officials who had come to participate in the Commonwealth Games-2010.

Later, the flats were allotted to those who had purchased them before or after the Games.

However, the Authority had later raised objections to the construction tower 5 and 15 on the ground of excess use of the FAR by the builder.

The Authority had sealed a total of 65 flats in the two towers on October 29 on that ground.

The Court also asked the Authority not to take any action in the matter till the petition was disposed of.
