The Delhi High Court on Friday refused to interfere in the process for the upcoming Delhi Assembly elections by restraining the Chief Electoral Officer from issuing notification for the polls. The matter was brought to the Court with an allegation that a large number of bogus voters were set to exercise their franchise.
Justice Vibhu Bakhru, hearing a petition moved by AICC member Naresh Kumar said the electoral process could not be stayed at this stage.
The poll process had to go on, said the Court.
The Court said it had already asked the Election Commission (EC) to revise the electoral rolls during the previous hearing on the writ petition and had even asked about the cause of errors.
The issue of several people in the Capital possessing more than one voter cards in their name with different addresses needed to be sorted out, it observed.
The Hight Court refused to grant any interim relief to Mr. Kumar, who contended that his writ petition would become infructuous if the election process was notified even when the discrepancies had not been sorted out and correct electoral rolls had not been prepared by removing bogus voters.
While rejecting the petitioner's request for stay of the notification till January 13,, the Court agreed to issue notice to the CEO’s office seeking its reply on Mr. Kumar’s interim application.
