Delhi Govt., DDA asked to look into cheating case

Dismissing a revision petition for a direction to lodge a cheating case against five persons for allegedly selling land to the petitioner by posing as owners, a Delhi court has asked the Delhi Police Commissioner and the DDA Vice-Chairmen to take necessary action against the culprits.

“From the record, prima facie parties in collusion with each other entered into the sale agreement of land which was already acquired by the government. During the course of arguments, it was alleged on behalf of the accused persons that the complainant had already sold some portion of land to different sellers.”

“In the first look it appears that probably all the parties i.e sellers and purchaser intentionally and knowingly entered into the sale agreement to defeat the purpose of land acquisition, to perpetuate the unauthorised encroachment and to cheat other innocent purchaser. It is a matter of detailed investigation by the authorities concerned,” the court further said.

“In order to protect the interest of bonafide owner i.e DDA/Govt. and to prevent any illegal transaction by anyone in respect of land in question, let a copy of the order be sent to Commissioner of Police, Delhi, as well as to Vice-Chairman, DDA, for information, record and necessary action (if any), the court ordered.

The complainant in the matter, Jai Singh, had purchased the 97 bigha and 15 biswa of land from the five accused persons and their co-sellers on the assurance by them that their land, which was earlier acquired by the Delhi Government and later transferred to the DDA, was later reverted back to them following quashing of the acquisition by courts here, the complaint alleged.

He further alleged that the landowners had cheated him of Rs.56 lakh by misrepresenting the status of the land. Initially, the buyer had lodged a complaint with the city police but later it filed a complaint before a Metropolitan Magistrate when the investigating agency did not register an FIR in the matter.
