Court dismisses Uber rape accused plea

A Sessions court here on Wednesday dismissed an application by accused Shiv Kumar Yadav seeking recall of all the prosecution witnesses for their re-examination in the Uber rape case, saying that it was an attempt to delay the trial.

Additional Sessions Judge Kaveri Baweja fixed Thursday as the day for restart of the final argument by the prosecution.

Counsel for the accused sought recall of the witnesses arguing that he was new to the case following the disengagement of the earlier lawyer by the accused.

The judge said that the change of the lawyer could not be a ground for recall of the witnesses.

Public Prosecutor Atul Srivastava submitted that counsel for the accused had filed the application only to delay the trial.
