Court discharges AAP MP in molestation case

‘Sanjay Singh incorrectly chargesheeted’

While discharging Aam Aadmi Party’s Rajya Sabha MP Sanjay Singh in a molestation case, a Delhi court has ordered framing of charges against two workers of the party for the same offence.

Additional Solicitor-General (ASG) Sanjay Jain had also advised the police that no case, including the charge of molestation, was made against Mr. Singh.

The police had sought his advice after lodging the case against Mr. Singh and the other accused on a complaint by a worker of the party.

Discharging Mr. Singh, Additional Chief Metropolitan Magistrate (ACMM) Samar Vishal said: “As per opinion of the ASG no case is made out against accused Sanjay Singh.”

“Independent of this opinion, I am also of the view that accused Sanjay Singh has been incorrectly chargesheeted by the police in the case,” the ACMM said. “In fact, he [Mr. Singh] was the victim, who was slapped by the complainant without any provocation on his part as is clear from her complaint as well as her statement under 164 of the Cr.P.C.” the ACMM said.

“Therefore, prosecuting him for the offence under Section 354/509 shall not be proper and will amount to prosecuting a victim himself,” said the ACMM.

‘Pushed complainant’

“As regards co-accused Ajit Tyagi and Inyatullah, there are allegations that they pushed the complainant by her chest. Let Sanjay Singh be discharged and let charge against Ajit Tyagi and Inyatullah under Section 354 [molestation] be framed,” the ACMM ordered.

According to the FIR lodged at Tilak Nagar Police station in West Delhi by the victim, the two accused had pushed the woman party worker by her chest when she was trying to talk to Mr. Singh over some local issues during a road show by the party.

The complainant later slapped Mr. Singh when he threatened her, the charge sheet alleged.
