The Delhi High Court on Wednesday left intact the ban imposed by the Transport Department on the operations of app-based cab service provider, Uber. It also refused to grant any interim relief on Uber’s writ petition challenging the rejection of its application for licence to operate in the Capital under the modified radio taxi scheme.
The Vacation Bench of Justice Mukta Gupta, however, issued notices to the Delhi Government and Delhi Police, asking them to file replies by July 8 on the plea that sought quashing of a June 3 order, which rejected the licence application of Uber India Technology Private Limited.
The Court observed that Uber cabs were not supposed to ply in Delhi if they did not have any licence. It said the cab company, by its own admission, had not been functioning in the Capital for the last six months. Uber’s counsel contended that the case was similar to that of two other app-based cab companies, Apra Cabs and Serendipity Infolabs, which were given relief by the High Court last week.
While the counsel sought parity with other cab operators, the Court said it would not pass any interim order till it gets replies of the Delhi Government and the Delhi Police.
