A Delhi court has acquitted three persons in murder case of 2009 as the deceased’s wife and nephew refused to support the prosecution case.
The Dabri police in South-West Delhi had registered the case on the basis of a complaint by the deceased’s wife. In her complaint, the deceased’s wife had alleged that the three accused had beaten her husband in his office. She also said that a few days before the incident her husband had an altercation with Naresh’s father Rs.10 lakh.
In her cross examination by counsel for the accused, she saidsaid she did not know the three accused in the court had beaten her husband. She also said she had named them on the basis of what others and her nephew told her about the incident, and her nephew’s version might be false.
“Raj Kumari (deceased’s wife) does not appear to be a reliable or credible witness as she has made inconsistent and contradictory statements in her examination-in-chief, cross examination by the defence counsel and in her re-examination by the prosecutor,” Additional Sessions Judge Paramjjt Singh said on the evidence given by the victim’s wife. About the evidence of the victim’s nephew, the Judge said, “Kanhaiya examined by the prosecution has resiled from his earlier statement and does not support the case of the prosecution.”
