Man let off after wife, another witness turn hostile

A Delhi court has acquitted a man who was charged with attempt to murder of his wife after the latter, as well as another witness, turned hostile during the trial of the case.

Also taken into consideration was the fact that the blood found on the clothes of the accused and the victim were found to be of different groups.

During the trial of the case, the victim said she did not see the person who had attacked her from behind.

“The prosecution failed to give a plausible explanation about the presence of blood of O group on the accused’s shirt, while the blood group of the victim appears to be B,” Special Judge Rakesh Pandit said in his judgment.

“On the shirt of the accused, the blood group O was found, while on the other exhibits blood, group B was found. From the perusal of the forensic report, it appears that the blood group of the victim is B,” the Judge further said.

The accused, in his defence, said that some unknown person had attacked his wife and the police implicated him in order to solve the case. The court also rejected the police claim that the accused himself had informed them over the phone about the crime as the agency failed to prove before the court that the alleged mobile number belonged to him.

The prosecution also failed to prove the motive of the crime and the connection between the weapon used in the crime and the wounds on the victim.

According to the police, on Ganesh Chaturthi in 2015, the accused had called his wife a few times over the phone but she did not pick up. When she returned home, the accused started quarrelling with her, took out a knife and stabbed her in the neck, the prosecution alleged.
