Forum holds firm guilty of ‘unfair trade practice’ regarding membership scheme

A district consumer disputes redressal forum here has directed Country Club to compensate a complainant by paying him over ₹1 lakh, after the club failed to provide membership as assured.

Holding Country Club guilty of “unfair trade practice”, the consumer panel said: “The whole scheme and conduct of the opposite party [Country Club] amounts to misrepresentation and deliberate deception…we find [Country Club] indulging in unfair trade practice by not providing free membership under the scheme and direct it to refund ₹1 lakh with interest.”

Complainant Akshay Goel had alleged that representatives of the company had assured him free membership under a 1+5 scheme, on payment of ₹1 lakh, which was refundable. Mr. Goel had alleged that despite paying the amount, his membership was degraded and amount not refunded.

The company, however, contended that no such scheme was offered to Mr. Goel.

“The opposite party has denied any promises for refund or adjustment of refund… it is submitted that the complainant himself sent a letter to the company to downgrade the membership on account of financial problem,” observed the panel, while noting the company’s contentions.

Referring to documents placed by the complainant and dismissing contentions put forth by the company, the consumer panel said: “This scheme clearly specifies that the introduction of five members are required for free membership. There are no riders or conditions attached to the scheme.”

The consumer panel also directed the company to pay ₹15,000 for harassment and litigation charges.
