Aam Aadmi Party (AAP) MLA Amanatullah Khan, who was arrested for allegedly assaulting Delhi Chief Secretary Anshu Prakash, moved the High Court on Tuesday seeking bail.

Mr. Khan’s bail plea is set to come up for hearing before Justice Mukta Gupta on Wednesday. The legislator approached the HC after his earlier bail plea was dismissed by a trial court.

Mr. Khan, in his plea, has sought release saying he was a sitting MLA and not a hardened criminal.

The MLA, who was arrested on February 21, is currently lodged in judicial custody in the case of alleged assault on the top bureaucrat during a meeting at Chief Minister's Arvind Kejriwal’s residence on the night of February 19.

Another MLA Prakash Jarwal was also arrested in the case. Mr. Jarwal’s bail plea is also pending before the High Court, which had sought response of the Delhi Police on the petition.

Plea dismissed twice

His bail plea was dismissed twice by a sessions court and a magisterial court.

A magisterial court had on February 23 refused to grant bail to the MLAs saying the matter cannot be treated in “a casual and routine manner”, while dubbing them as “history-sheeters”.

Both the MLAs were sent to 14-day judicial custody on February 22. Deoli MLA Mr. Jarwal was arrested on February 20 while Okhla MLA Mr. Khan was taken into custody the next day.
