A local court here on Monday rejected the bail plea of a juvenile delinquent in the murder case of a Class II student in Bhondsi last year.
Hearing the arguments of the Central Bureau of Investigation (CBI) and the complainant, the court of Additional and District Sessions Judge J.S. Kundu rejected the bail plea. The 17-year-old had filed a bail plea before the court on November 1 through his father after his application for a regular bail was turned down by the Juvenile Justice Board (JJB).
The juvenile delinquent’s counsel Vishal Gupta had taken the plea that the JJB had completely failed to appreciate that though the custody of the appellant was almost nearing a year, no concrete proceedings had taken place so far thus denying the appellant of his fundamental right to speedy trial.
He also argued that the teenager was a minor, having absolutely no delinquent antecedents and had always been in great loving care of his parents. “He was a regular student at the time of the alleged incident,” said the bail application filed by the juvenile, seeking that the court set aside the JJ Board order on October 30 rejecting the bail and grant bail to him.
The CBI opposed the bail and requested the court to consider the manner of commission of crime, motive of crime, magnitude of the crime and the personality of the victim before deciding on the plea.
The complainant’s counsel Sushil Tekriwal said the juvenile in conflict with law was dangerous to the society.
