The family of a 27-year-old man who died after being hit by a rashly-driven bus have been awarded a compensation of over Rs.89 lakh by a Motor Accident Claims Tribunal here.
Tribunal presiding officer Ravinder Bedi directed The New India Assurance Co. Ltd., insurer of the offending bus, to pay a compensation of Rs.89,98,840 to the wife, parents and two children of Sawal Dass, who died in an accident here in 2013.
“I have looked into the criminal case record, site plan, mechanical inspection report as well as the charge sheet filed by the Investigating Officer. The site plan and location of the vehicles itself amply suggests the negligent and rash manner in which the offending bus, after jumping traffic signals, hit the motorcycle coming from the right side,” Mr. Bedi said.
According to the petition filed by the victim’s family, he was travelling from his office on a motorcycle in the morning on February 5, 2013. As he reached the traffic signal at Mayur Vihar on National Highway 24, his motorcycle was hit by the bus and fell due to the impact. Sawal was declared brought dead at Lal Bahadur Shastri Hospital. Sawal earned Rs.32,679 per month and his family had filed a claim for Rs.80 lakh as compensation for his death. He also worked as part-time stenographer in the office of an advocate.
The driver and owner of the bus filed written statements contending that they were falsely implicated by the police in collusion with the petitioners. — PTI
