Accident death: ₹18.15 lakh compensation to woman’s kin

She was killed in a bus-truck collision on her way to office

A Motor Accident Claims Tribunal has compensated with ₹18.15 lakh the mother of a 27-year-old woman who was killed in an accident on her way to work in a staff bus in 2014.

The victim worked in a private company. She was among the three employees of the company who were killed in the accident in Noida, when a truck coming from the wrong side after having jumped the red light, hit their bus.

The victim, a section manager, earned a salary of ₹11,405 a month. Her mother and brother, in the claim petition, had sought a compensation of ₹55 lakh.

Opposing the petition, the insurance company submitted that there was contributory negligence on the part of the bus driver as both the vehicles had collided in the middle of a traffic junction. At the most, it might be said that both the vehicles were equally responsible, the counsel for the insurance company further submitted.

The presiding officer of the tribunal, Vivek Kumar Gulia, however, rejected this argument and said that the eyewitness to the accident made it clear that the truck had hit the bus on the driver’s side in the middle of the traffic junction, meaning that the offending vehicle could not apply break in time to avert the accident.

The eyewitness, Rajesh Jayant, who was travelling along with the victim, deposed that the truck had jumped the red right and was running at a high speed.

“Thus, it is proven on record that victim Ranjeeta died consequent to the injuries sustained in a motor vehicular accident due to rash and negligent driving of the offending vehicle by truck driver Hawa Singh,” Mr. Gulia said.

“The Tribunal awards a total compensation of ₹18,15,000, along with 9% interest per annum from the date of filing of the petition [26.09.2014] till the date of realisation, to the victim’s mother. The insurer shall deposit the award amount with the tribunal within 30 days,” Mr. Gulia ordered.
