The Delhi High Court on Friday directed a private school here to take back a Class VIII boy student who was suspended for wearing low-waist jeans to school on July 29 this year.
Asking the school authorities to allow the student to attend classes from this coming Monday, a Division Bench of the Court comprising Justice Mukul Mudagl and Justice Reva Khetrapal said that to wear low-waist jeans by students in schools was not indecent.
The matter was resolved amicably before the Bench when counsel for the school agreed to take back the student.
The Court asked the father of the student to tender an apology to the school authorities for his impolite behaviour over suspension of his son.
The father had moved the High Court against a Single Judge Bench order rejecting his petition against the decision of the school.
Counsel for the petitioner, Ashok Agarwal, argued that as per Rule 37 of the Delhi School Education Rules-1973 and Section 16 of The Right of Children to Free and Compulsory Education Act, 2009, no school can take punitive action against children below 14 years of age.
The action by the school against the student also violated the Fundamental Rights enshrined in the Constitution, Mr. Aggarwal submitted.
