After HC order, govt moves files to L-G for nod

Days after it suffered a setback in the High Court, which ruled a number of its decisions “illegal” as they were taken without input from the Lieutenant-Governor, the Delhi government has now sent the file pertaining to the appointment of Krishna Saini as the Chairperson of the Delhi Electricity Regulatory Commission (DERC) to the L-G.

Another file for appointment of directors in the Board of distribution companies has also been moved to the L-G for his approval.

Sources in the L-G’s office confirmed that the files are now being reviewed by L-G Najeeb Jung.

After the High Court struck down the appointment of nominee directors of the Delhi government on the Board of the three discoms, the government has now re-nominated officials.

“The government has recommended the same officials for the post of nominee directors and the L-G has to approve it now. We are following court orders,” said a senior government official.

The recommended directors are Sanjeev Singh, Managing Director of Delhi Transco Limited, Anjani Kumar Sharma, Sudhir Verma, Prem Prakash and Arun Kumar Garg.

The move comes after the HC on August 4 had termed the government’s policy directive of penalising discoms for unscheduled power cuts and appointment of directors to the Board of discoms as “illegal” and “unconstitutional” because views of the L-G were not sought on the issues. The policy was not implemented yet as a gazzette notification was awaited.

As reported by The Hindu earlier, the order affects all directives that the government had issued to the DERC under Section 108 of the Electricity Act, 2013 — the most important being that of the DERC chief — as none of the files were sent to the L-G.
