₹52.56 lakh awarded to sanitation worker’s kin

The family of a female safai karamchari of South Delhi Municipal Corporation has been awarded ₹52.56 lakh compensation by a Motor Accident Claims Tribunal in a 2017 road accident death case.

The deceased’s husband was separately awarded ₹4.54 lakh for the injuries he had suffered in the accident.

A tanker had hit the couple from behind when they were returning home on their two-wheeler from the civic body’s office. The woman was riding pillion.

The man is also an employee of the local body.

The insurance company with which the tanker was insured opposed the claim petition, submitting that the accident happened not because of the negligence of the driver of the offending vehicle but due to the negligence on the part of the husband of the deceased, who was driving the scooty in a rash and negligent manner.

The owner of the tanker also opposed the claim plea.

Holding the tanker driver responsible for the mishap, however, Presiding Officer of the tribunal, Sameer Bajpai, directed the insurance company to pay ₹52.56 lakh to the deceased’s family.

Mr. Bajpai finalised the compensation amount by fixing her salary at ₹41.16 by adding 30% to her net salary of ₹31.66 under future prospects head. This benefit is available only for a government employee under the Motor Vehicles Act.
