HC stays CAT order in Sindhuri case

The Karnataka High Court on Friday stayed the judgment of the Central Administrative Tribunal (CAT), which had upheld the State government’s order of transferring IAS officer Rohini Sindhuri Dasari from the post of Hassan Deputy Commissioner, besides setting aside the IAS (Cadre) Amendment Rules 2014, which stipulates minimum tenure for cadre posts and constituting civil services board to recommend transfer of IAS officers.

A Division Bench, comprising Justice H.G. Ramesh and Justice B. Sreenivase Gowda, passed the interim order on the petition filed by Ms. Sindhuri, who had questioned the April 17 verdict of the Tribunal.

In her petition, she said that the CAT, without examining the question of validity of the March 7, 2018 Government Order of “prematurely” transferring her from the post of Hassan DC, virtually wrote “a thesis and not a judgment” with sweeping directions “sitting in judgement over the judgment of the Supreme Court and also badly commenting on the wisdom of the Supreme Court”.
