Ownership of a Road.

Mr. K. Srinivasa Iyengar and Mr. V.M. Dorai Rajah, High Court Vakils, on behalf of Rai Sahib C.T. Muthiah Chettiar and the Zemindar of Andipatty, applied [to the Madras High Court] for stay of proceedings in a case under Sections 145 and 147 of the criminal procedure code at present pending before the Sub-Divisional Magistrate of Ramnad. The parties in the case were the Hon’ble Rao Bahadur Annamalai Chetty on one side and Rao Saheb C.T. Muthiah Chetty and his brother on the other. The matter under dispute related to the ownership of a road which one party claimed as public property while the other claimed it as private property. On behalf of Mr. Muthiah Chettiar and his brother a revision petition questioning the jurisdiction of the Magistrate to try the case was at present pending and till this was disposed of a stay of proceedings in the original case was asked for. Mr. A. Krishnaswamy Iyer, High Court Vakil, opposed the motion on behalf of Mr. Annamalai Chettiar. His Lordship [Vacation Judge, Justice C.V. Kumaraswami Sastry] granted stay of proceedings and directed that the hearing of the revision petition be advanced and posted for hearing during vacation.
