A single judge in the Madras High Court bench here on Wednesday ruled that candidates with post graduate degrees and bachelor of education degrees obtained in Tamil medium are entitled for recruitment by the Teachers Recruitment Board (TRB) under the benefit of preferential right as per the Tamil Nadu appointment on Preferential Basis in the services under the State of persons studied in Tamil Medium Act, 2010.
Justice S. Nagamuthu issued the ruling while allowing two petitions filed by the candidates, who were not considered for appointment as post-graduate assistants by the TRB under the preferential basis, because the petitioners did not obtain their under graduate degrees in Tamil medium.
In his order, Justice Nagamuthu observed that, “It is suffice that the candidates have studied the post-graduate and bachelor of education courses in Tamil medium. The medium of instruction in under graduate course is immaterial (for recruitment).”
In their petitions, the petitioners had contended that though they had obtained their under graduate degrees in English medium, they had obtained their post graduate degrees in Master of Commerce and B.Ed degrees with Tamil as their medium of instruction.
They had cleared the written examination and attended the certificate verification conducted by the TRB for the selection of PG assistants in commerce on October 23, 2013, they submitted.
However, their candidature under the preferential right as per the Tamil Nadu appointment on Preferential Basis in the services under the State of persons studied in Tamil Medium Act was rejected on the grounds that they completed their under-graduate courses in English medium, the petitioners had claimed.
On the directions of the court, the deputy secretary of the school education department had submitted a counter-affidavit contending that candidates who had obtained all their degrees in Tamil medium were alone entitled for recruitment by the TRB under the preferential basis under the Tamil Nadu appointment on Preferential Basis in the services under the State of persons studied in Tamil Medium Act.
Justice Nagamuthu also directed the TRB to appoint the petitioners as post-graduate assistants if they satisfied the other qualifications required.
