MADURAI: Allowing a habeas corpus petition filed by a youth, the Madras High Court Bench here has quashed a police order detaining his 45-year-old mother under the Goondas Act.
A Division Bench of Justices P. Murgesen and C.S. Karnan set aside the order passed by the Police Commissioner here on December 15, 2008 on the ground of delay in considering a representation by the detenu. According to the police, at least three cases were pending against the woman under the Narcotic Drugs and Psychotropic Substances Act, 1985 before different stations in the city limits for sale of ‘ganja.’
She was branded a drug offender and detained under the Act. She was lodged in a sub-jail for women at Nilakottai in Dindigul district as a remand prisoner in one of the cases when the preventive detention order was passed.
The judges pointed out that a representation presented by the detenu to revoke the detention order was rejected by the Law Minister on February 4. But, the rejection order was served on the detainee only on February 11.
