The Madras High Court on Thursday quashed the detention of Thalli MLA T. Ramachandran of CPI under the Goondas Act.
A Division Bench, comprising Justices K.N. Basha and P. Devadass allowed the petitions challenging the detention of the legislator and 16 others, including his father-in-law Laghumaiah and brother Varadarajan.
The legislator surrendered before the Judicial Magistrate, Tiruvannamalai, on July 30 in connection with a case pertaining to the alleged murder of Periyar Dravidar Kazhagam Krishnagiri district convener, T. Palani alias Palanisamy, by a gang at Balapuram village on July 5 last year.
The Uthanapalli police had registered a case against Mr. Ramachandran and several others.
They were detained under the Goondas Act on the orders of the Krishnagiri District Collector. The MLA was detained on September 24. His mother-in-law Sundaravalli challenged the detention.
The Bench said the detention orders had been passed without application of mind in a mechanical fashion and in the absence of cogent material available on record.
