The Madurai District Consumer Disputes Redressal Forum here has asked a courier service firm to pay Rs. 25,022 to one of its customers after it failed to deliver a mail to the recipient.

P. Deivaraj, president of the forum, and N. Thilagam, member, issued the directions after hearing the grievance of A. Nagarathinam, a resident of S.S. Colony in Madurai. Mr Nagarathinam claimed that his daughter’s wedding was called off, resulting in mental agony and subsequent hospitalisation due to the negligent service of the courier service firm.

According to Mr. Nagarathinam, he sent the mail containing his daughter’s horoscope and photographs to the family of a prospective marriage alliance in Coimbatore through ‘The Professional Couriers’ on January 7, 2011. He had also received a receipt from the courier service firm after paying Rs. 22, but claimed that the post did not reach the groom’s family.

When he enquired about the status of the post a few days later, the courier service firm gave him an inconsiderate reply, Mr. Nagarathinam stated. The groom’s family called off the marriage alliance because the post did not reach them and the agony made him fall ill, leading to his hospitalisation, he claimed.

Mr. Nagarathinam then sent a legal notice on January 14, 2011, to the courier service firm through his advocate seeking a compensation of Rs. 1 lakh for its deficient service, which stopped his daughter’s marriage, and also led to his hospitalisation. When the firm failed to respond to the notice, he moved the Forum stating that the firm should pay him the compensation for its deficient service. The courier service firm made no appearance in the forum as well.

The Forum held that the litigant was just in his claim and directed ‘The Professional Couriers’ to pay Rs. 20,000 compensation for deficient service and Rs. 5,000 towards court expenses to Mr. Nagarathinam, along with Rs. 22 he had paid for a mail that was not delivered.
