The Madras High Court has dismissed a public interest litigation seeking to order CB CID probe into criminal cases against a Coimbatore-based advocate, who was accused of murdering his client and used the body to obtain death certificate as if his wife had died.

Declining to order CB CID probe, the First Bench comprising, Chief Justice R.K.Agrawal and Justice M.Sathyanarayanan said, “The investigation is at the threshold and the accused were also arrested. Therefore, it is pre-mature to transfer the investigation to CB CID.”

Relying on a newspaper report, R.Santhosh Kumar, a social worker, filed the PIL seeking to transfer the criminal cases against the lawyer pending on the file of three police stations in Coimbatore to CB CID for further investigation. Pointing out that the petitioner filed the PIL solely on a news report, the Bench held that the petitioner failed to furnish legally acceptable evidence and materials.
