CHENNAI: The Madras High Court on Tuesday dismissed a public interest litigation petition seeking a Central Bureau of Investigation (CBI) probe into the recent death of a Sri Lankan fishermen union leader.

Warnakulasooriya Canicius Fernando was shot dead by a warden at the Madurai Central Prison on October 5 when he did not respond to queries of security personnel.

The First Bench, comprising Chief Justice A.P. Shah and Justice V. Ramasubramanian, dismissed the petition filed by advocate A.P. Suryaprasakasam on the ground that the warden involved had been suspended and a magisterial inquiry instituted by the Government.

“In view of the fact that the magisterial inquiry has already been ordered and, in the mean time, the warden has been placed under suspension, no interference is warranted at this stage.” the Bench said.

The petitioner said the matter should be treated as a case of murder, and criticised higher officials of the Prison Department for attempting to “justify” the action.
