Should appear before CBI for three days

The Madras High Court on Wednesday granted anticipatory bail to the chairman and managing trustee of the SRM Medical College Hospital and Research Centre, Potheri, and his son, in a case relating to alleged collection of capitation fee.

Granting the relief, Justice R. Subbiah said the chairman, T.R. Pachamuthu, and his son, Ravi Pachamuthu, trustee of the centre, should be released on bail in the event of their arrest. The conditions included that the two should appear before CBI for three days from April 1 and thereafter as and when required.

In the petitions, Dr. Pachamuthu and Mr. Ravi Pachamuthu said the CBI, Anti-Corruption Branch, had issued a notice on March 15 requiring them to appear before the agency on March 25 for answering questions relating to capitation fee in respect of an MBBS student of the college which is a deemed-to-be university. The institution did not collect any capitation fee from any student.

The petitioners were at a loss to understand as to on what basis the CBI issued the impugned notice, describing the case as one relating to alleged fee/capitation. After receiving the necessary documents from the institution, the investigating agency had issued the notice.

The petitioner’s counsel, Abudukumar Rajaratnam, submitted that the institution’s Registrar appeared before the CBI on March 25 and provided all necessary details.
