The High Court on Monday issued notices to the State government and the SCB medical college authorities to file counters within three days in response to a writ filed by one Susanata Mallick, who claims that his newborn baby boy was swapped in the Cuttack Hospital.

The Division Bench headed Chief Justice V. Gopala Gowda issuing notices to the respondents has fixed Thursday for the next hearing of the case, informed the petitioner advocate Gopal Krushna Mohanty.

The petitioner, a native of Asureswar of Cuttack district is claiming that his wife Rashmita had delivered a baby boy in the Hospital on March 30. But the hospital authorities are insisting that his wife had delivered a baby girl and are not allowing her to leave the hospital without the baby girl.

Urging the HC for a direction to the appropriate authorities to discharge his wife Rashmita from the Hospital along with the baby boy she had delivered, Susanta in his petition had also urged the Court to conduct a DNA test to ascertain the parents of the baby girl who is now lying unclaimed in the Hospital.

Meanwhile, the district child welfare committee (CWC) has approached the Hospital authorities asking the latter to hand over the unclaimed baby girl to an orphanage.

But the Hospital authorities are unable to take any decision about the child since the matter has now reached the High Court and the Court is already seized over the case.

“We cannot take any decision about the baby right now as the matter is now sub-judice and we are also a respondent in the case”, informed the Hospital sources.
