NEW DELHI: The Supreme Court on Monday said that construction of a third floor would be permissible only in residential localities and not in commercial areas of the Capital.

A Bench of Justice Arijit Pasayat and Justice P. Sathasivam clarified that its earlier order permitting construction of a third floor was restricted only to residential users. The Court clarified the order after MCD counsel Sanjiv Sen moved an application before the Bench seeking to know whether such constructions were permissible in commercial areas.

Counsel claimed that such a clarification was essential as the MCD officials were confused about the applicability of the Bench’s earlier direction.

“There is no need for clarification. Your officials deal on case-to-case basis and suitcase-to-suitcase basis,” the Bench remarked sarcastically, disposing of the MCD application. - PTI
