The Himachal Pradesh High Court on Thursday directed Public Works Department Principal Secretary to file a reply by the month-end on the delayed progress of works undertaken under the Jawaharlal Nehru National Urban Renewal Mission in the hill town.

A Division Bench of the High Court has also directed that there shall not be any construction on either side of any motorable road without obtaining clearance from the Assistant Engineer of the PWD sub-division. The restriction with regard to prior permission shall be applicable to the construction of Government as well as private buildings.

The Court has also directed the PWD to ensure that there is no construction on the actual width meant for the road in any place.

The actual width of the road will not only mean tarred surface but also the width meant for road at the time of acquisition for the road. The Court also clarified there shall be no relaxation for construction on this actual road width.

The Court added that despite the availability of two legislations,

The Himachal Pradesh Roadside Land Control Act, 1968, and The Himachal Pradesh Road Infrastructure Protection Act, 2002, there is hardly any space for development of roads on either side.

The Court directed PWD Secretary to make a preliminary proposal with regard to Sanjauli-Dhalli tunnel for widening the existing one or construction of fresh tunnel from JNNURM funds within three weeks.
