‘Efforts to draft a new Act for governance of the civic body'

‘Constitution of the expert committee is illegal'

NEW DELHI: Leader of the House in Municipal Corporation of Delhi Subhash Arya on Wednesday said the Delhi Government's efforts to draft a new Act for governance of the civic body was unconstitutional and illegal.

In a statement, Mr. Arya said the core committee of the BJP would call on Union Home Minister P. Chidambaram to seek his intervention in the matter.

“The State Government issued an order on February 26 forming an expert committee on the subject. The Delhi Municipal Corporation Act, 1957, was promulgated by an Act of Parliament. The Delhi Government has absolutely no powers to amend the Act or prepare a new Act. The constitution of the expert committee is unconstitutional and illegal,” he added.

Pointing out that the MCD was an autonomous body, Mr. Arya said the Delhi Government's efforts to weaken it have yielded no result. “Its last move resulted in transfer of just 17 of 518 powers under the DMC Act. Now the Government is determined to transfer the powers back to the Union Government,” he added.
