Reacting to the Supreme Court order striking down of the Airport Development Fee levied and collected at some airports, the Delhi International Airport Limited said in a statement on Tuesday that although the Supreme Court “has allowed the appeal of the petitioners who had challenged the judgment of Delhi High Court upholding the levy of ADF, the Supreme Court has allowed DIAL to continue to charge ADF as per the approval granted to DIAL by the Airport Economic Regulatory Authority.”

The statement further claimed that the Supreme Court had observed that “in view of the facts of the case, DIAL shall not be obliged to refund any amounts collected by it prior to the approval granted by AERA” and ADF recovered by DIAL would be used only for purpose of development of the Delhi airport.
