NEW DELHI: The Delhi High Court will on Thursday pronounce judgment on public interest litigation by voluntary organisation Naaz Foundation seeking legal sanction for homosexuality through repeal of or amendment to Section 377 of the Indian Penal Code wherein the practice of unnatural sex is a criminal offence.

The Court had reserved the judgment in November last year.

The Union Home Affairs and Health and Family Welfare Ministries had taken a diametrically opposite stand on the petition during the hearing. The Home Ministry argued for retention of the penal provision while the Health and Family Welfare Ministry argued for its repeal or an amendment to it permitting a physical relationship between consenting adult homosexuals.

The Home Ministry argued that if the relevant section was deleted it would open the floodgates for delinquent behaviour.
