NEW DELHI: Two persons accused of kidnapping and criminally assaulting a 16-year-old girl have been acquitted by a court here.
Additional Sessions Judge R.K. Yadav acquitted Mohammad saying the victim had been making contradictory statements. Another accused in the case, Iqbal, was acquitted for lack of evidence.
The court said the victim had alleged before the police that she was kidnapped by the accused but not physically abused. But in her deposition before the court, she charged Mohammad with criminal assault. Further, the court noted that the circumstances indicated that the victim had physical relations with the accused in the capacity of his wife, a situation which nowhere makes that act penal.
According to the prosecution, the girl was taken away to an undisclosed location and returned after five days. During that period, the accused allegedly married her. Iqbal helped Mohammad in kidnapping the girl.
