Warrant of appointment is expected in a couple of days after completion of certain formalities

New Delhi: President Pratibha Patil has cleared the appointment of advocate R. Subbiah as Madras High Court Judge.

He is the son of Justice S. Ratnavel Pandian, former Supreme Court Judge. According to Law Ministry sources, the warrant of appointment is expected in a couple of days after completion of certain formalities.

Meanwhile, the Law Ministry is likely to delink the names of advocates S. Sathyanarayanan and K. Kannan, who were cleared by the Supreme Court collegium but yet to be sent to the President for appointment. Indications are that the name of Mr. Sathyanarayanan would be sent to the President and the name of Mr. Kannan would be referred to the Supreme Court collegium along with the comments of the Tamil Nadu government.

According to sources, the decision to delink the two names is a sequel to a writ petition filed by the Revenue Bar Association in the Madras High Court for a direction to the Union Government to forward the names of those who had been cleared by the Supreme Court collegium to the President for appointment as Judges.

It was alleged that the names of Mr. Kannan and Mr. Sathyanarayanan were not forwarded to the President even though all the procedural formalities and legal requirements were fully complied with.

The court had asked the Central government counsel to get instructions from the Union Government and inform the court. The Centre after considering all aspects is likely to forward the name of Mr. Sathyanarayanan to the President for appointment as a judge.

Meanwhile, Additional Solicitor-General V.T. Gopalan, representing the Centre in the Madras High Court and the High Courts in the southern region, whose term is due to end next year, has submitted his resignation.

Senior advocate M. Ravindran, practising in the Madras High Court is likely to be appointed as the next ASG to succeed Mr. Gopalan, according to highly placed sources.
