The Judicial First Class Magistrate II here Mohammed Raees has dismissed an application by Tenny Joppan and Saritha S. Nair, accused in the solar scam case, seeking a copy of the statement given by ‘scam victim’ R. Sreedharan Nair under Section 164 of the Code of Criminal Procedure.

The magistrate dismissed the application on Thursday, accepting the prosecution’s argument that giving a copy of the statement made before the Judicial First Class Magistrate at Ranni on July 6 may lead to destruction of evidence by the accused.

Ranni Judicial First Class Magistrate Dony Thomas Varghese recorded the statement of Mr. Sreedharan Nair on July 6 afternoon in connection with the latter’s complaint against Saritha and another accused, Biju Radhakrishnan.

In his petition filed before the Judicial First Class Magistrate II in Pathanamthitta on June 12, Mr. Nair alleged that Saritha and Biju had cheated him of Rs.40 lakh, promising to set up a 3-MW solar power plant near Palakkad.
