The Kerala High Court on Thursday set aside a State government order taking over 24 hectares in Mupply Estate in Thrissur, which was leased out to Harrisons Malayalam Limited.

Justice B.P. Ray passed the judgment on a writ petition challenging the takeover order. The government had taken over land in 2007 on the ground of violation of the lease agreement conditions. The government had alleged that the company had sub-leased the land to another person, violating the conditions of the lease agreement.

Quashing the order, the court observed that the agreement did not contain any provision that the leased land should not be subleased. The company had contended that it had not been heard before passing the take-over order.
