Kochi: The Labour Court, Ernakulam, on Tuesday held that AppukkuttanVallikunnu, former associate editor of the Desabhimani daily, was entitled to pay and allowance for the period from November 1, 1998, to December 20, 2005.

The court also held that the denial of employment from September 9, 1998, till his date of retirement on December 20, 2005, was unjustifiable.

It also observed that treating the period from September 9, 1998, till the date of his retirement as leave without allowance could not be justified.

He was paid salary for September and October 1998.

According to the petition filed by Mr. Appukkuttan Vallikunnu, he was expelled from the Communist Party of India (Marxist) in August 1998.

Though the party Central Control Commission had declared his expulsion unsustainable, the decision had not been implemented. He was asked to resign by the general manager and thereafter the management stopped paying salary.

The court observed that the contention of the management that he had unauthorisedly absented from duty was not correct.

The court found that the management had restrained the workman from attending his duties though he was willing to attend the office.
