Activist refuses to pay for the data citing a clause in the Act

Joint Secretary Law and the First Appellate Authority S.G. Marathe on Wednesday directed the Public Information Officer (PIO) and Under Secretary Law Vasanti Parvatkar to furnish to rights activist Aires Rodrigues the information sought by him under the Right to Information (RTI) Act pertaining to the fees paid to Advocate General(AG) of Goa Atmaram Nadkarni.

Mr. Rodrigues, through an application on May 10, had sought a copy of all the bills submitted by the Advocate General from March 2012 onwards.

After sitting on the application for almost a month, the PIO forwarded the application of Mr. Rodrigues to the AG seeking to know whether the information sought by Mr. Rodrigues could be furnished or not.

Aggrieved by the failure of the PIO to furnish the information, Mr. Rodrigues filed an appeal before the First Appellate Authority who while ruling that Mr. Rodrigues was entitled to the information sought by him, directed the PIO to furnish the information within 10 days.

The PIO accordingly has now asked Mr. Rodrigues to collect the information after paying the requisite fees of Rs. 464, but Mr. Rodrigues has said that he would file an appeal before the State Information Commission as he was entitled to the information free of cost as per Sec 7(6) of the RTI Act as it was not furnished to him within the mandatory 30 days.
