The skeletal staff left of the Goa State Police Complaint Authority (SPCA) is eagerly waiting for the newly appointed chairman R.M.S. Khandeparkar, retired High Court judge, to take charge as their salaries for the last month remain unpaid in the absence of a drawing and disbursing officer (DDO) or an authority to sign the salary bills and time-bound bills of the office.
Moreover, the absence of a gazetted officer at the helm has left the staff clueless over the action to be taken on applications seeking information under Right to Information Act and so on.
Following indications from the government, chairman Eurico Santana da Silva, retired judge, resigned on January 25 followed by members Norbert Moraes and Shantkumar B. Bhat on January 28 and M.G. Naik who resigned on personal grounds on June 27, 2012. While the SPCA was reconstituted with Mr. Khandeparkar as chairman on February 1 for a five-year term, the government is yet to nominate members.
Though the Chief Minister recently told presspersons that Mr. Khandeparkar would soon take charge and begin work at SPCA, given the present rules of proceedings he needs at least one other member to form the quorum to conduct proceedings.
With the previous government having gone ahead with notifying the previous SPCA in a hurry just in response to the Supreme Court directive, there were no rules framed.
Following which, the former chairman Mr. Silva framed his own set of rules and procedure to conduct the proceedings.
As per those rules, “proceedings shall always be presided over by the chairman, but if he was unavailable for any reason he may delegate to any member the power to preside over the hearings. At all times, the quorum shall consist of chairman and one member.”
On February 14, the office of the SPCA wrote to the Under Secretary, Home, stating that Mr. Khandeparkar was yet to take charge and that the SPCA was now without any gazetted officer and DDO.
According to sources, the delay has been because the government intends to simultaneously provide Mr. Khandeparkar facilities on the same premises to conduct his proceedings as head of the high power committee on mining.
Sources in the Home Department said names of remaining members of SPCA would soon be notified.
