Court issues order on petition from gram panchayat Court issues order on petition from gram panchayat

Karwar: The Court of the Civil Judge (Junior Division), Ankola, has restrained Advani Exports Ltd. from dumping red soil or storing iron ore on any part of the beach at Belekeri village till further orders.

This ad-interim ex parte temporary injunction was issued on Monday following a petition by the Belekeri Gram Panchayat.

The panchayat, represented by its president, in its petition, had submitted before the court that the company, which was exporting iron ore from Belekeri port, started encroaching upon Belekeri beach in the first week of May by dumping red soil and storing iron ore on the encroached land. The company had not obtained permission from either the panchayat or the Union Government through the Ministry of Environment and Forests under the Coastal Regulation Zone (CRZ) Rules. When the panchayat issued a notice to the company, the company replied that it had secured approval from the Director of Ports and Inland Water Transport. The panchayat argued that even if the Director of Ports had given permission to the company, clearance from the panchayat and the Centre was necessary.

The panchayat argued that the beach provided shelter to hundreds of families of fishermen. Belekeri beach attracted tourists and nature lovers from all over the country. Dumping of red soil on the beach and storing iron ore would damage the environment. The act of the company was against public interest, the panchayat said.
