VISAKHAPATNAM: Panchayats, municipalities and the municipal corporation have no right to approve lay-out plans (LPs) as the Visakhapatnam Metropolitan Region (VMR) is under the jurisdiction of VUDA. Stating this, VUDA authorities said that under the A.P. Urban Areas (Development) Act of 1975, only VUDA is empowered to approve lay-outs in rural and urban areas under VMR.
In the VMR area in Visakhapatnam and Vizianagaram districts the plots approved by VUDA with lay-out plans will be legally tenable.
Also, for development of lay-outs in the Visakhapatnam Municipal Corporation area and 287 villages in the vicinity and Vizianagaram, Bhimili, Gajuwaka and Anakapalle municipalities obtaining the lay-out plan from the VUDA is mandatory. For areas not under the purview of VUDA, the Town and Country Planning Director will approve the lay-out plans.
However, gram panchayats and municipalities can recommend the approval of the lay-out plan to VUDA.
The recommendation had to be made after ascertaining the land utilisation, ownership, approach roads etc., and after collecting the prescribed fee. They cannot unilaterally approve the lay-out.
VUDA's assertion comes in the wake of some developers selling plots stating that gram panchayat has approved the lay-outs.
The land-deals will be legal only if the LP is obtained from VUDA. Government agencies will not permit construction, development or re-sale without VUDA approval. Registration would not be done and financial assistance would not be provided by lending agencies, VUDA authorities cautioned.
Plea to buyers
VUDA Vice-Chairman G. Venkatram Reddy wanted prospective buyers to find out VUDA LP number from developers.
