Deputy Leader of the TDLP and the Nagari MLA G. Muddukrishnama Naidu has raised a legal point over K. Rosaiah's continuance as the Chief Minister as he was sworn into the post only on the basis of the Congress President Sonia Gandhi's reported ‘nomination letter' to the Governor naming him as the CLP leader and not on the basis of the mandatory resolution to be passed by the Legislative Assembly, duly electing him as the leader of the ‘Congress Legislative Party', as is Constitutionally required.

As such his continuance as the Chief Minister is not legally tenable and he would be in trouble if any one challenged it in the court, said Naidu, who has taken up cudgels against the Chief Minister at his press meet here on Thursday.
