I was issued an H1B visa in August. In the annotation section, it says ‘Not valid until September 2013’. I currently possess two I-797A approvals. I haven’t changed employers and don’t have any gap of status. Can I not travel until September 2013? Can I get the annotation amended?
You may not travel to the U.S. more than 10 days prior to your current petition start date listed on the I-797.
If your previous petition is valid until the start date of your new petition, and you are continuing to work for the same petitioner, the visa can be issued without that annotation and you can travel on it immediately.
