The CJM court would take up the police prayer on Tuesday when Mr. Gogoi would be produced before the court, he said.
The court had earlier granted bail to Mr. Gogoi in three cases, including the case of self-immolation by KMSS activist Pranab Boro in front of the Assam Secretariat on February 24 during an agitation for land rights by the organisation.
Mr. Gogoi and five of his associates were arrested on March 2 on under Section 306 (abetment to commit suicide) and 120(B) (criminal conspiracy) of the Indian Penal Code and later sent to jail.
Hundreds of KMSS activists and supporters staged a dharna in the city demanding the unconditional release of Mr. Gogoi and other jailed KMSS leaders.
