Justice Nooty Ramamohana Rao of the High Court on Wednesday made it clear that there shall be no construction activity on the premises of the Islamic Arabic School located at Tondawada village, near Tirupati.
A team comprising Revenue Divisional officer(RDO), Deputy Superintendent of Police (DSP ) and others shall visit the alleged illegal structure to ascertain when the inmates will vacate if they are there, he said.
The judge was passing these series of orders after hearing a batch of writ petitions filed regarding this issue. It may be recalled that there has been controversy on this structure constructed by the Madarasa-e-Niswan-Isha-Atul-Islam Urdu and Arabic Development Society through its president Ms. Shaik Nowheera.
This society filed a writ petition contending that the Tondawada panchayat was threatening to demolish the building though they had given explanation and were ready to pay the amount to regularize the extra floors constructed by them.
Series of petitions
The second writ petition was filed challenging the orders of the district Collector who directed the local panchayat to demolish the portions of the structure which have come up violating the sanctioned plan.
The police and the officials of the Tirupathi Urban Development Authority (TUDA) were also asked to help the panchayat in the demolition.
The Tirumala Tirupathi Samrakshna Samithi (TTSS) filed a petition to implead into this case and opposed grant of any interim orders.
S. Muni Gangi Reddy, former Sarpanch of Chandragiri, also filed a separate writ petition seeking demolition of the structure.
The fromer Sarpanch also contended that the officers conducted an inquiry and found that the ‘Kalva Poromoboke’ has been encroached upon. He contended that the Suvaranamukhi Rejuvenation Project will be affected by the move.
The judge wanted the Madarasa-e-Niswan-Isha-Atul-Islam Urdu and Arabic Development Society to explain how six floors were constructed when permission was granted for the ground and first floor only.
Justice Ramamohana Rao expressed concern about the safety of the girls who are going to be put up in the building.
