Lok Satta Party has said that Governor E.S.L Narasimhan should not have cleared the appointment of Justice B. Subhashan Reddy as Lokayukta just because the State government sent the file a second time after he turned down it once.
According to the Human Rights Commission Act passed by the Parliament, the Chairman and members of HRC were not eligible for further government employment once they cease to hold office. Thus, Justice Subhashan Reddy who had served as Chairman of the Human Rights Commission was therefore not eligible for the appointment, said Lok Satta Party president Jayaprakash Narayan here on Thursday.
However, official sources said that after the Governor returned the file, citing the Central law, State Government sought legal opinion and cited a Kerala High Court verdict in support of the appointment.
The file, re-sent by the Chief Minister, further stated that the Kerala High Court judgement upholding the appointment of Lokayukta in that State was endorsed by the Supreme Court and hence it was applicable to Andhra Pradesh too.
Addressing media persons, he however said the government’s argument did not wash as the Central law was supreme.
He also said his observations were no reflection on Justice Subhashan Reddy who had served as Chief Justice of Tamil Nadu and Kerala High Courts. But he hoped Justice Subhashan Reddy would take a decision in tune with the spirit of the law concerned and the Constitution.
Dr.Jayaprakash Narayan while welcoming the move by the Prime Minister Manmohan Singh to bring a law against collusive corruption involving the corporate sector and public servants, said that the Centre should incorporate the suggestions of Administrative Reforms Commission into the proposed law.
