A Division Bench of the High Court comprising Justice G. Raghuram and Justice M.S. Ramachadra Rao on Thursday quashed the notices issued by the CEO of Secunderabad Cantonment Board to increase the property tax by three times for the period 2009-2012. The bench was dealing with a batch of writ petitions challenging the notices issued by the CEO.
The bench felt that only the Board can initiate such revision of the property tax, and CEO cannot himself undertake such revision. The CEO increased the property tax assessment for the period from April 2009 to March 2012 in the Cantonment area and this lead to the present litigation. The bench directed the officers of the Cantonment not to take any coercive steps to recover the amounts mentioned in the notice.
