The Supreme Court on Wednesday issued notice to the CBI on a special leave petition filed by Bangaru Laxman, former president of the BJP, challenging the order of the special judge, CBI taking cognisance of the offence of the “sting operation” conducted by Tehelka.

Mr. Laxman questioned the order on the ground that a criminal prosecution, arising out of allegations based solely on “sting operation” was not at all maintainable. He said special judge ought not to have granted pardon exercising powers under Section 306 of Cr. PC at a stage when neither chargesheet was filed nor cognizance was taken.
