CHENNAI: The Madras High Court has ordered notice to the Government on a habeas corpus petition seeking the release of three persons, including V. Sundaramoorthy, who was arrested by the Q Branch police in Tirupur on Tuesday.

A Division Bench, comprising Justice Prafulla Kumar Misra and Justice R. Banumathi, ordered the notice, returnable by July 13, after an urgent hearing of a petition filed by advocate G. Haribabu, general secretary of the Centre for Protection of Civil Liberties (Tamil Nadu).

The petitioner submitted that Mr. Sundaramoorthy of Ramayampatti in Dharmapuri district was arrested along with M. Karthi of Ammapet in Salem district and M. Eswaran of Mettupatti in Theni district on July 8 itself.

Apprehending threat to the lives of the detenus, the petitioner said though they were picked up by the Q Branch on July 8 itself, they were neither produced in any court nor remanded to judicial custody. Attempts to contact the Superintendent of Police of the Q Branch police proved futile as there was no response from the other end.

During arguments, Mr. Justice Misra referred to the photographs of the detenus published in various dailies, and wondered whether it would not affect the case if there arose a need to hold an identification parade at a later stage. He adjourned the matter to Friday for further proceedings.
